Lesson Waiver

Liabilities:

Customers (including but not limited to parents, legal guardians of minors, students and adult students) hereby release South Windsor School of Music Inc. (“South Windsor School of Music”) and its directors, officers, agents, shareholders, contractors, employees, heirs, successors, administrators, and assigns (“Personnel”) from any and all proceedings, causes of actions, claims and demands for damages, indemnity, costs, interests, loss or injury of every nature and kind whatsoever and howsoever arising, with respect to lessons and educational activities of the South Windsor School of Music or to any other ancillary activities conducted by the students under the supervision of any Personnel including virtual lessons. Virtual lessons include lessons over digital interface through mediums such as Skype, Facebook, etc.The sole exception to this section is reimbursement for lessons as contemplated by the School’s refund policy.

Care of Students:

South Windsor School of Music and Personnel are not responsible for providing care and/or supervision of students during their virtual lessons. Parents with students 6 years old and younger must remain in the room during virtual lessons.

South Windsor School of Music is not responsible for providing care and/or supervision of students before or after in-school lessons. Parents with students under 6 years old must remain in the school during lessons. Students are not to be left at the school for no longer than 5 minutes before or after their lessons.

Although all efforts will be made to control program content, there may be instances of uncensored material accessible through our services beyond South Windsor School of Music's control.

A Note on Email and Virtual Meetings:

The security of email is not guaranteed but is an accepted part of business in this day and age. While we contact you through email or transmit personal information
through email, we cannot guarantee the security of email. By agreeing to receive email communications from us, you acknowledge this risk.

Similarly, we cannot guarantee the security of virtual meetings. There have been reports in the media that individuals have “bombed” virtual meetings held through
Zoom and other programs. The South Windsor School of Music strives to take efforts to protect students from such hackings, such as using passwords to access lessons.

Privacy Statement:

Under the Personal Information Protection and Electronic Documents Act (PIPEDA), the South Windsor School of Music has certain obligations with respect to the collection, use and disclosure of personal information.

“Personal Information” is defined in PIPEDA as information about an identifiable individual, but does not include the name, title or business address or telephone
number of an employee of an organization. It includes such things as your name, address, age, photographs, date of birth, gender, and credit card information.

We collect information only by lawful and fair means, and not in an unreasonably intrusive way. Generally, we collect your personal information directly from you.
When you register or pay for a course at our school, we will record information such as your name and address. We may also collect information during the course of our virtual lessons (e.g. when you log on to Zoom for lessons, your name may be recorded).

We retain your information for as long as necessary to comply with regulatory and other legal requirements. For example, we may be required to retain a copy of an
invoice for review by Canada Revenue Agency.

We limit the collection of personal information about you. If the personal information we require is collected for a reason other than as outlined in this Privacy Statement or if a new purpose arises, we will seek your further consent.

We do not sell your information.We may use your personal information for analytics about our customer base and we may have to transmit some of your basic information to third parties such as a credit card company or Bank in order to process payments.

We store your information in secure forms and limit access to your personal information on a “need to know basis”. For example, any paper copies of personal information (e.g. invoices and receipts) are locked in a cabinet and only accessible to management. Electronic forms of personal information are protected by email encryption or password.

When you or someone you have authorized, provides us with your Personal Information, you are consenting to our collection, use and disclosure of that Personal Information for the purposes outlined in this Privacy Statement.

Photos:

We may also collect videos/photographs of you or your children during lessons, programs and at public events put on by the South Windsor School of Music for use in promotional material that is available to the public. You agree to this collection and use.

BY SIGNING THIS WAIVER YOU ACKNOWLEDGE YOU CONSENT TO OUR PRIVACY STATEMENT. You can change your consent preferences or withdraw your consent for the collection, use and disclosure of any or all of your Personal Information, at any time (see contact information below). It is important to note, however, that when you change or withdraw your consent, it will not have a retroactive effect. Please note that certain information, such as your name and address may have to be retained in order to comply with regulatory requirements.
